The short version

Use Nest for your own screen time, or as a parent or guardian on your child's device. Never use it to monitor another adult.
Nest is free today. If we add paid features in the future, they'll be handled by Google Play, under Google Play's payment and refund rules.
Nest helps you set limits, but it can't guarantee they'll never be bypassed. It doesn't replace a parent's involvement.
Your rights as a consumer under the law always apply, whatever these terms say.

1. About these terms

These terms are an agreement between you and Albert Gil Peiro ("we", "us"), Av. Josep Tarradellas 54, 08029 Barcelona, Spain, contact hello@nestbalance.app. They apply when you download or use the Nest app for Android. By using Nest, you agree to these terms. If you don't agree, please don't use the app.

2. Who can use Nest

You must be at least 18 years old, or the age of majority where you live, to use Nest.

In parental control mode, you may install and set up Nest only on a device used by a child for whom you are the parent or legal guardian. We encourage you to tell your child that Nest is installed and how it works.

You may not use Nest to monitor or restrict another adult's device, or anyone's device without the legal right to do so.

3. Your license to use Nest

We grant you a personal, non-exclusive, non-transferable license to use Nest on Android devices you own or control, for non-commercial purposes. The app, its design, and its content belong to us. You may not copy, modify, resell, or reverse engineer Nest, except where the law allows it.

4. Price and future paid features

Nest is currently free to download and use. If we introduce paid features or subscriptions in the future, we'll tell you clearly in the app before you pay anything. Any purchases will be processed by Google Play, under the payment terms of your Google Play account. We never receive your payment details.

If paid features are introduced, the following applies:

Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You can cancel anytime in Google Play under Payments and subscriptions.
Free trials and offers are described in the app or on our website when you get them. When a trial ends, the subscription starts unless you cancel before then.
Prices are shown in Google Play before you buy. If a subscription price changes, Google Play will notify you in advance.
Refunds are handled under Google Play's refund policy. Your statutory consumer rights are not affected.

5. How limits work, and their limitations

Nest uses Android features, including the Accessibility Service, to track screen time and enforce limits. Because of how Android works, limits may not apply in every situation. For example, they may stop working if:

the Accessibility permission is turned off, or Nest is uninstalled or force-stopped
the phone's manufacturer restricts apps running in the background
the device is reset, or its date and time are changed

We work to make Nest reliable, but we can't guarantee that limits can never be bypassed. In parental control mode, Nest is a tool to support your parenting, not a replacement for your supervision.

6. Nest Score and insights

The Nest Score, reports, and insights are for general information only. They are not medical, psychological, or professional advice.

7. Acceptable use

You agree not to use Nest to break the law, to monitor anyone without the legal right to do so, or to interfere with the app's normal operation.

8. Privacy

Your screen time data stays on your device. Read our privacy policy to learn what data Nest collects and how it's used.

9. Changes to Nest and to these terms

We may update Nest to add, change, or remove features. If we change these terms in a significant way, we'll let you know in the app before the changes apply. If you keep using Nest after that, the updated terms apply to you.

10. Ending your use of Nest

You can stop using Nest at any time by uninstalling it. Uninstalling doesn't cancel a subscription, so remember to cancel it in Google Play. We may suspend or end your access if you seriously or repeatedly break these terms.

11. Warranties and liability

We provide Nest "as is." To the extent the law allows, we don't guarantee that it will always be available, error-free, or suitable for your specific needs.

To the extent the law allows, we are not liable for indirect or consequential losses, or for losses caused by limits not being enforced. Nothing in these terms limits our liability for intentional misconduct, gross negligence, death or personal injury, or any liability that can't be limited by law. If you're a consumer, you keep all the rights that consumer protection law gives you.

12. Governing law

These terms are governed by Spanish law. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts of your place of residence.
